The Training Programme for Lawyers Serving International Integration has been deployed by the Judicial Academy pursuant to Decision No. 123/QĐ-TTg dated 18 January 2010 of the Prime Minister on the Scheme for developing lawyers serving international economic integration. The Programme aims to build high-quality legal human resources, meeting the requirements of judicial reform and extensive integration. The Cohort 9 class in Hanoi has attracted many lawyers, legal officers and personnel in the legal industry to study and connect.

In the topic “Skills for participating in the settlement of foreign-related commercial and investment disputes by mediation”, Director Nguyen Thi Mai presented an overview of commercial mediation, from its history and development trends to its practical application in Vietnam and around the world. In a highly volatile commercial and investment environment, which entails an increasing need to resolve complex foreign-related disputes, mediation is assessed as the optimal settlement method thanks to its flexibility and confidentiality, its savings in time and costs and, above all, the fact that it helps businesses preserve their business cooperation relationships.

In addition, Director Nguyen Thi Mai clarified the pivotal role of legal departments and lawyers in the process of resolving disputes by mediation, while also sharing professional practice and the development prospects of this method in Vietnam. She emphasized the importance of proactively incorporating a mediation clause right from the stage of negotiating and concluding the contract, especially for transactions involving foreign elements, to ensure transparency and effectiveness. On this occasion, the VMC Director also introduced VMC’s model dispute resolution clause so that lawyers may refer to it and include it in contracts when advising businesses.
